A CHARTER ORDINANCE AMENDING SECTION 9 OF CHARTER ORDINANCE NO. 15 RELATING TO THE NUMBER OF MEMBERS CONSTITUTING THE CONVENTION AND VISITORS BUREAU OF THE CITY OF ABILENE, KANSAS

WHEREAS, the City of Abilene, Kansas, is a city of the Second Class; WHEREAS, K.S.A. 12-1696 to 12-16,101, inclusive, authorizes a levy by cities of a transient guest tax, which provisions are not uniformly applicable to all cities; and

WHEREAS, the City of Abilene, Kansas, has previously adopted Charter Ordinance No. 15, and subsequent amendments thereto, exempting itself from the provisions of K.S.A. 12-1696 to 12-16,101, inclusive, and to provide substitute and additional provisions as set forth in that ordinance and subsequent amendments thereto; and

WHEREAS, pursuant to Article 12, Section 5(c)(4), cities may amend previously adopted Charter Ordinances.

THEREFORE, BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF ABILENE, KANSAS:

SECTION 1. That Section 9 of Charter Ordinance No. 15, and subsequent amendments thereto, relating to the number of members constituting the Convention and Visitor Bureau, is hereby amended to state as follows:

       Section 9. A “Convention and Visitors Bureau” is hereby established to advise the Governing Body and make recommendations concerning programs and expenditures for conventions and tourism. The Bureau will consist of seven members appointed by the Mayor and confirmed by the City Commission. Initially, four members shall be appointed for terms ending April 30, 2014; two members for terms ending April 30, 2015; and one member shall be a representative designated by the Abilene Area Chamber of Commerce, who shall serve for a one-year term. Thereafter, at the expiration of terms of the original members, their successors shall be appointed for terms of three years each, and each shall serve until a successor is appointed and qualified. The member from the Abilene Area Chamber of Commerce shall serve a one-year term ending April 301h each year. Any vacancies in the membership of the Bureau shall be filled by appointment of a new member as in the case of the original appointment, to fill the unexpired term of the member whose office is vacant.
