CHAPTER I. ADMINISTRATIONCHAPTER I. ADMINISTRATION\Article 10. Oaths, Bonds, And Seal

All officers of the city, whether elected or appointed, either under the laws of the State of Kansas or ordinances of the city, shall, before entering upon the duties of the respective office, subscribe an oath or affirmation as follows:

       “I do solemnly (swear or affirm) that I will support the constitution of the State of Kansas and faithfully discharge the duties of (enter name of office).”

Each member of the Governing Body shall, before entering upon the duties of such office, give a good and sufficient corporate surety bond, to be executed by a responsible bonding company authorized to do business in the State of Kansas, payable to and for the use and benefit of the City of Abilene, in the sum of five thousand dollars ($5,000), conditioned for the faithful discharge of the official duties, and to save the city harmless from all loss caused by neglect of duty or malfeasance in office, or for the willful expenditure or misappropriation of any moneys, property or securities of such city in violation of law. Said bonds in each case before being accepted shall be approved by the Judge of the District Court of Dickinson County, Kansas. The cost of such surety bonds shall be borne by the city.

The city officers and employees shall each give a good and sufficient corporate surety bond to the City of Abilene, which shall be approved as hereinafter provided before such officer or employee shall begin the performance of such duties, and shall be in the following respective amounts:

(a)   City Clerk - $100,000.00

(b)   City Treasurer/Finance Director - $100,000.00

(c)   All other officers and employees - $5,000.00

Each of the bonds shall be conditioned for the faithful performance of duty and of all acts required by the laws of the State of Kansas and the ordinances of the city, and for the application and payment to the proper persons of all moneys or property coming into the possession of each such officer by virtue of such office. Each of the bonds shall be approved as to their form by the City Attorney and as to surety and sufficiency by the Governing Body. The cost of such surety bonds shall be borne by the city.

The corporate seal of the city shall contain the following words, to wit: “The City of Abilene, State of Kansas.” The City Clerk shall be the keeper of said seal and shall affix it to all instruments and papers as required by the laws of the State of Kansas or the ordinances of the city.
